JOB DESCRIPTION:
Tenet Healthcare seeks to add a Senior Counsel, Operations to its legal team based in its Dallas, Texas headquarters or Nashville, TN. The successful lawyer will join a high impact and growing legal team and be expected to provide legal advice on a wide variety of matters related to Tenet’s portfolio of hospitals.
The Senior Counsel, Operations responsibilities will include the review and analysis of all arrangements between Tenet facilities and other parties for compliance with Stark, anti-kickback and other fraud and abuse laws, EMTALA, HIPAA, and any other regulatory requirements applicable to such arrangements. The Senior Counsel will also be required to give training presentations to Tenet personnel from time-to-time on legal issues that pertain to facility operations.
- Structure and review hospital operations contractual and operational arrangements to comply with applicable laws.
- In conjunction with facilities and contract administration, develop, review and approve contractual arrangements for facilities as required by policy and otherwise as requested
- Effectively advise hospital personnel on the application of Tenet policies
- Effectively advise hospital leadership and medical staff on physician credentialing and peer review matters
- Review and approve all changes to medical staff bylaws
- Provide education and support on regulatory matters, adherence to company policy, and alignment with company strategy and core values.
- Maintain current, comprehensive knowledge of applicable law and policies
- Coordinate and collaborate with others in the Tenet Law Department and other Tenet Home Office Departments to obtain input and approval of hospital operations arrangements, provide company-wide advice in areas of individual specialty and develop policies and practices to facilitate the highest levels of legal and ethical performance.
- Direct contract administrators supporting the assigned facilities.
- Participate in weekly or bi-weekly contract calls with facilities to provide updates on matters relevant to facility legal operations, including policy and process changes, status of contracts in process, and to obtain information needed from facilities to advance legal operations matters
- Advise contract administrators on eCATS package contents, including drafting and attachments
- Offer guidance related to substantive support of contractual arrangements, including assessments of fair market value
- Oversee litigation for collection matters and provide operations support for litigation matters directed by other members of the Law Department
- Manage Compliance Matters at assigned facilities.
- Direct compliance investigators in attorney-directed matters, including legal analysis and determination of remediation, if any
- Advise as requested on general compliance investigations and compliance matters
- Maintain positive professional relationships with facility personnel, market leadership, Law Department colleagues and other members of the Tenet Healthcare enterprise
- Demonstrate timely, effective responsiveness to client needs
- Other duties as assigned.
REQUIRED SKILLS:
A minimum of five years of experience in health care law is required. Solid experience in a healthcare operations law practice, as well as a working knowledge of health care regulations, are required. This includes experience in health care-related drafting and transactional matters. Prior large law firm experience is highly preferred.
Additionally, the successful lawyer must be self-motivated, organized, a team player and work well in a high-energy and fast-paced environment. The lawyer filling this position must also possess excellent interpersonal communication skills with the ability to interact with individuals at all levels of the company, including senior corporate executives and outside counsel. This position will involve handling confidential matters requiring the exercise of good judgment and discretion.

Juris Doctor Degree from an ASA Accredited Law School is required and fully qualified to practice in the State of Texas or Tennessee.
